Questions in Punishment & Penalties

This is a question of Jewish law in a case pertaining to murder/killing in the course of a robbery. The defendant was in a bank and stabbed a guard with a knife; the guard died instantly. There were two witnesses, one of whom tried to warn the defendant that he would be subject to death if he killed the guard. However, the murderer did not acknowledge her warning. The other witness just stood idly by. If we are trying to offer a defense for the defendant, what would Jewish law say that might help do so?

We haven't heard much about the death penalty lately, but public debate surrounding capital punishment seems to flare every so often. I'm never sure how I feel about it - on one hand, "an eye for an eye" is surely justice served. On the other, who are we to play God, particularly when the US criminal justice system is so flawed? How can jewish values inform our views on the issue?

People say what comes around goes around, and others add "and I would like to be there to see it". Is the idea of 'payback' actually a core belief of any religion, especially Judaism, and is that attitude of wishing to witness the repercussions of their acts on another person coming home to roost an act of a wholesome and ethical individual?

Are you bound to make amends to a wronged person, who does not know that you wronged them, directly to that individual or with G-d only?
